FIRST, I WANT TO ACKNOWLEDGE AND THANK THE TOWN STAFF, THE PLANNING COMMISSION, THE DESIGN REVIEW COMMISSION FOR THE THOUGHTFUL WORK ALREADY INVESTED IN THIS PROJECT. WE ESPECIALLY APPRECIATE THE CITIZEN CONCERNS WERE HEARD AND WERE REFLECTED IN THE CONDITIONS OF APPROVAL LAST YEAR BY THE DESIGN COMMISSION, INCLUDING REQUIREMENTS FOR ADDITIONAL LANDSCAPING AND SCREENING NEAR THE DOG PARK AND TRASH COMPACTOR AREAS BEING PLANNED. WE DO RECOGNIZE THAT GROWTH IS PART OF COLLEGE COLLEGE'S FUTURE, AND WE'RE NOT HERE OPPOSING DEVELOPMENT ITSELF. WHAT PORTER FARMS RESIDENTS ARE ASKING FOR IS SOMETHING VERY REASONABLE, THAT GROWTH BE DESIGNED IN A WAY THAT RESPECTS EXISTING NEIGHBORHOODS THAT HAVE CARED FOR THIS AREA FOR MANY YEARS.ONE OF THE MOST IMPORTANT TRANSITION AREAS BETWEEN THE WATER TOWER DISTRICT, PHASE TWO AND PORTER FARM SEVEN, IS THE WOODED BUFFER ALONG THE WESTERN EDGE OF THE PROPERTY. TODAY, THE AREA PROVIDES VISUAL SCREENING, NOISE REDUCTION, SHADE, WILDLIFE HABITAT AND A NATURAL CHARACTER THAT CONTRIBUTES SIGNIFICANTLY TO OUR QUALITY OF LIFE, OURS AND

OF MANY NEIGHBORS IN THE NEIGHBORING SUBDIVISIONS. THE STAFF REPORT ITSELF ACKNOWLEDGES THAT THIS AREA SERVES AS A BUFFER TO THE NEIGHBORHOOD AND SCREENS THE AREA WHERE THE PROPOSED TRASH COMPACTOR IS PLANNED TO BE PLACED. WE ALSO RESPECTFULLY ASK THAT THE TOWN AND DEVELOPER CONTINUE EVALUATING WHETHER THE TRASH COMPACTOR ITSELF COULD BE RELOCATED FARTHER AWAY FROM THE RESIDENTIAL EDGE OF PORTER FARMS AND CLOSER CLOSER NORTH TO THE HOTEL AREA, WHERE IT'S ALREADY A SERVICE AREA AND THERE'S ALREADY A TRASH COMPACTOR IN THAT AREA. AND WE SAY THAT BECAUSE EVEN WITH ADDED SCREENING, THIS USE INTRODUCES CONCERNS RELATED TO NOISE, ODORS, LIGHTING, TRUCK ACTIVITY AND LONG TERM COMPATIBILITY. GIVEN THE CLOSE PROXIMITY TO EXISTING HOMES, WE BELIEVE WE BELIEVE EXPLORING RELOCATION OR RECONFIGURATION NOW DURING THE FINAL SITE PLAN STAGE COULD SIGNIFICANTLY IMPROVE THE RELATIONSHIP BETWEEN THE DEVELOPMENT AND THE NEIGHBORING RESIDENTS FOR DECADES TO COME. OUR CONCERN IS THE MINIMUM SCREENING MAY NOT NECESSARILY RESULT IN AN OUTCOME THAT IS TRULY ADEQUATE FOR THE FAMILIES THAT LIVE NEARBY, SO WE BELIEVE THIS TRANSITION REPRESENTS AN OPPORTUNITY, AND WE REALLY ASK FOR YOUR CONSIDERATION WHEN TALKING WITH THE DEVELOPER TO TRY TO CONVINCE THEM TO GO BEYOND WHAT'S MINIMALLY REQUIRED BECAUSE THEY CAN MEET MINIMUM REQUIREMENTS, BUT STILL HAVE NOT NECESSARILY A POSITIVE IMPACT. I PLAN TO MOVE TO COLLIERVILLE TO TRY TO PROSPER BECAUSE COLLIERVILLE HAS ALWAYS BEEN KNOWN FOR EXCELLENCE. WE HAVE BLACK MOLD COMING FROM OUR CEILING, OUR VENTS. WE ARE NOT ALLOWED TO RUN OUR AIR CONDITIONER BECAUSE OF THE SICKNESS I RECENTLY STARTED. I RECENTLY LOST MY JOB BECAUSE OF EXCESSIVE SICKNESS WITHIN MY ALLOTTED PERIOD OF TIME THAT I WAS WORKING, THAT I HAD STARTED WORKING. MY FIANCE HAS BEEN HOSPITALIZED BECAUSE OF THE SICKNESS. WITH PHASE FOUR COMPLETED IN DECEMBER OF 2025, THE WALNUT STREET IMPROVEMENT PROJECT WAS ABLE TO MOVE FORWARD, SO WE HAD TO DO SOME WORK DOWNSTREAM BEFORE WE COULD ACTUALLY START THIS. THIS GOES UNDER THE RAILROAD, GOES DOWN ON THE WEST SIDE OF THE POST OFFICE AND GOES ON DOWN AND EMPTIES INTO THE THE LATERAL THAT WE JUST GOT THROUGH WITH THE BIG BOX CULVERT ON. SO THIS THAT'S WHERE THIS WILL END UP FLOWING TO. THE WORK FOR THIS PROJECT WILL INCLUDE 450FT OF DRAINAGE PIPE, 18 TO 42 INCH IN DIAMETER, EIGHT DRAINAGE STRUCTURES, ASPHALT PATCHING, TRAFFIC CONTROL, AND ALL THE OTHER ITEMS NECESSARY TO COMPLETE THE PROJECT. TO HAVE WALNUT STREET BACK OPEN. SEVEN VENDORS REQUESTED COPIES OF THE PLANS, AND ON APRIL 1ST, FOUR BIDS WERE RECEIVED FROM QUALIFIED CONTRACTORS. THE BID CONSISTS OF A BASE BID WITH NO ALTERNATIVES. AT THE EVALUATION BIDS, IT WAS DETERMINED THAT IN SCORE WAS THE LOWEST AND MOST RESPONSIVE BIDDER, WITH A BID AMOUNT OF $303,645.40. THE PROPOSED AMENDMENT RAISES THE PENALTY TO $50 PER OCCURRENCE FOR ALARM USERS WHO EXPERIENCE THREE OR MORE FALSE ALARMS WITHIN A 12 MONTH PERIOD. IF YOU LOOK AT THE BACKGROUND ON THIS, THE TOWN OF COLLIERVILLE EXPERIENCES A SIGNIFICANT NUMBER OF FALSE ALARMS FOR SERVICE, REQUIRING BOTH THE POLICE AND FIRE DEPARTMENTS.THESE CALLS REQUIRE PERSONNEL TO RESPOND AND INVESTIGATE, TAKING RESOURCES AWAY FROM PRIORITY CALLS AND OTHER PROACTIVE ACTIVITIES. I'M NOT GOING TO GO THROUGH ALL THE THE YEARS, BUT BASICALLY THE LAST FOUR YEARS WE'VE AVERAGED OVER 2000 FALSE ALARMS A YEAR. THE CURRENT ORDINANCE PROVIDES A PROGRESSIVE ENFORCEMENT STRUCTURE WITH PENALTIES BEGINNING AFTER MULTIPLE FALSE ALARMS WITHIN THE 12 MONTH PERIOD. HOWEVER, THE EXISTING PENALTY HAS HAD LIMITED IMPACT ON REDUCING REPEAT FALSE ALARM ACTIVITY. FALSE ALARM CALLS FOR SERVICE CONTINUE TO PLACE DEMAND ON BOTH POLICE AND FIRE RESOURCES. EACH RESPONSE REQUIRES PERSONNEL TO BE DISPATCHED, RESPOND TO THE SCENE. ENSURE THAT NO ACTIVE EMERGENCY FOR POLICE RESPONSE IS. THIS MEANS TWO OFFICERS ARE TYPICALLY DISPATCHED TO AN ALARM FOR FIRE RESPONSE DEPENDING ON THE TYPE OF ALARM. IT'S. TWO OR MORE STATIONS MAY BE DISPATCHED. WHILE NECESSARY FOR PUBLIC SAFETY, THESE RESPONSES REDUCES AVAILABILITY OF OFFICERS AND FIREFIGHTERS FOR PRIORITY CALLS AND OTHER PROACTIVE EFFORTS WITHIN THE COMMUNITY. ANALYSIS OF THE DATA SHOWS RELATIVELY SMALL NUMBER OF USERS ARE RESPONSIBLE FOR A DISPROPORTIONATE NUMBER OF THESE CALLS. THESE FALSE ALARMS, THE CURRENT PENALTY STRUCTURE, WHICH BEGINS AFTER MULTIPLE FALSE ALARMS, HAS NOT BEEN SUFFICIENT TO CHANGE BEHAVIOR AMONG THE REPEAT OFFENDERS. LAST WEEK I HEARD LAST WEEK, BEFORE I'D HEARD ABOUT THIS ORDINANCE, I WAS ALREADY PLANNING TO UP MY ADVERTISING BUDGET FOR COLLIERVILLE. 25% OF THE POOLS THAT I'VE BUILT IN THE LAST SEVERAL YEARS IN FAYETTE AND SHELBY COUNTY HAVE BEEN RIGHT HERE IN COLLIERVILLE. RIGHT NOW, I AM IN THE MIDST OF A FOUR POOLS IN A ROW THAT I'M BUILDING RIGHT HERE IN COLLIERVILLE. I FULLY UNDERSTAND AND RESPECT THE FACT THAT THE TOWN IS TRYING TO UNDERSTAND AND ADDRESS LEGITIMATE CONCERNS REGARDING DRAINAGE AND RUNOFF. I BELIEVE EVERYONE IN THIS ROOM WANTS RESPONSIBLE DEVELOPMENT AND PROPER STORMWATER MANAGEMENT.
